1.            Rename existing streets in conjunction with the Enhanced 911 Street Naming and Addressing Project within the Kenai Peninsula Borough. Streets under consideration at this meeting are described as follows:

 

g.         Nancy Court within Kimbrel Subdivision Gibson 1981 Subdivision of Tracts 3, 4 & 9 (KN 82-63), Section 22, T4N, R11W, S.M., AK; Location: north of Tote Road, Soldotna area

Background:  Two streets in ESN 302 are named Nancy:

 

Nancy Court

Nancy Street

Nancy Court was named and dedicated in January 1982.

Nancy Street was first shown and named in January 1974.

6 adjoining parcels (1 owner)

8 adjoining parcels (7 owners)

all vacant

6 residential; 2 vacant

Nancy Court is constructed.

Nancy Street is constructed.

Addresses issued:  3 Nancy Court, 2 Naomi Street

Addresses issued:  5 Nancy Street, 2 West Poppy Lane

No one uses Nancy Court for their mailing address.

2 owners use Nancy Street for their mailing address.

 

Review and Comments:

 

No comments from agencies were received when the staff report was prepared.

 

Nancy Mitchell, daughter of Dwain Gibson the original subdivider, phoned staff.  Her father is out of state caring for her ailing mother.  Mr. Gibson objected to renaming Nancy Court.  Ms. Mitchell agreed to represent him in this matter.  She suggested Nancy Anne Court, which was not approved.

 

Staff Discussion:

 

Based on the number of adjoining parcels, number of owners, six residential parcels, date of the recorded plat, number of Nancy Street addresses issued, and two owners using Nancy Street for their mailing address, staff is proposing to rename Nancy Court.

 

Staff faxed additional information to Ms. Mitchell.  Although Nancy Court is named for Ms. Mitchell, she understood why staff is proposing to rename it.  She suggested Dwain for her father and brother.  Although her father objects to renaming Nancy Court, he agreed with Dwain if the street must be renamed.  Mr. and Mrs. Gibson own all adjoining parcels.

 

ESN 401 (Anchor Point) has Duane Street; ESN 401 is not adjacent to ESN 302.  No other streets in KPB are named Duane/Dwayne/DeWayne.

 

Public notice was published on June 16, 2006 in the Peninsula Clarion.  Public notice was also published on June 22 as part of the tentative agenda in the Peninsula Clarion, Homer News, and Seward Phoenix Log.

 

Notices were sent by regular mail to the property owners as shown on the KPB tax roll in accordance with Section 14.10.055 Borough Code of Ordinances.  Notices were sent to interested parties and agencies as well as local post offices and/or community libraries for posting on the public bulletin board.  Public notice was published on the Planning Department web site and on the bulletin board in the Borough Administration Building.

 

The following statements were included in the public notice to adjoining owners.  The first two statements were included in the ad published in the newspaper.  Staff believes this is sufficient notification that a name other than the name recommended by staff may be approved during the hearing.

 

PLEASE NOTE:  The Planning Commission may approve a name suggested by landowners, interested parties, or the planning staff.  An entirely different name can also be suggested and approved by the Commission during the public hearing.

 

NOTE:  Upon adoption of a street name change resolution, no reapplication or petition concerning the name of the same street may be filed within one calendar year of the final adoption, except in the case where new evidence or circumstances exist that were not available, present or reasonably ascertainable when the original resolution was adopted (KPB 14.10.050).

 

Reapplications/petitions are submitted per KPB 14.10.050, which includes a $300 filing fee.

 

The name change will become official upon the adoption of a resolution by the Planning Commission at the next available meeting following the approval of the name change.

 

Staff defers to the majority of adjoining property owners for the new street name SUBJECT TO the requested name being not being a duplicate or sound alike of an existing street name in ESN 302 or an adjacent ESN.

 

STAFF RECOMMENDATION:   Rename Nancy Court within Kimbrel Subdivision Gibson 1981 Subdivision of Tracts 3, 4 & 9 (KN 82-63) to DWAIN COURT.
