SUBJECT: Ordinance 99-48 sunset date

Please find for your consideration an ordinance extending the sunset date for Ordinance 99-48 until February 28, 2001. It will only be necessary to adopt this ordinance if the assembly sets additional public hearings on the ordinance being introduced on November 21 and set for hearing on December 12 entitled "An ordinance amending KPB 14.40 regarding control and construction of borough rights-of-way." Ordinance 99-48, which provided a permitting system allowing for the incremental improvement of borough rights-of-way, contained a sunset clause with a date of December 31, 2000. If the date is not extended, the former law, Ordinance 98-09, will be reinstated. Ordinance 98-09 provided that all right-of-way permits require roads be constructed to borough standards. The ordinance pending before the assembly regarding the permitting system for construction within borough rights-of-way retains the provisions for the incremental improvement of borough rights-of-way adopted by Ordinance 99-48 and moves all right-of-way permitting to the KPB Road Service Area.
