MEMORANDUM
TO: William R. Popp, Assembly President
Members, Kenai Peninsula Borough Assembly
FROM: Jack Brown, Assembly Member
DATE: January 6, 2000
SUBJECT: Ordinance 2000-03, Amending Vacancy provisions
At the request of a constituent, the accompanying ordinance is introduced for your consideration in order to require that a vacancy be declared on the assembly for the same reasons stated in Alaska Statutes. The current language appears to give the assembly discretion to not declare a vacancy in many of the listed circumstances, such as being convicted of a felony.
As the Alaska Statutes do not address members moving out of the district from which they were elected, I believe it would make sense to leave the existing paragraph C unchanged.
