Subject: Resolution 2004-105, Authorizing the mayor to execute cooperative agreements with the cities of Homer, Kenai, and Soldotna and the Kenai Peninsula Arctic Winter Games 2006 Host Society

As you may recall, the Kenai Peninsula Borough executed an agreement with the Arctic Winter Games International Committee in April, 2003, in which it agreed to form a host society to conduct the Arctic Winter Games. The cities of the Kenai Peninsula Borough were not included in that agreement. However, the cities of Homer, Kenai, and Soldotna in particular have been actively involved in assisting with preparations for staging the Arctic Winter Games through the host society. This resolution would memorialize the borough's three-way relationship between the borough, the cities and the host society and authorize the joint exercise of powers necessary to support the host society staging the games. At the time of packet closing, the City of Kenai had not yet acted upon the resolution authorizing the city manager to enter into the cooperative agreement, but is scheduled to do so on October 6, 2004. The assembly will be provided with information concerning the City of Kenai's action on or before October 12, 2004.

Attached please find copies of the resolutions by the cities of Homer and Soldotna approving the cooperative agreement. To summarize, the agreements include a provision for the cooperative exercise of powers between the borough and cities necessary to stage the 2006 Arctic Winter Games, an agreement to cooperate with the borough regarding certain requirements of the Arctic Winter Games International Committee, and identification of areas in which the parties may negotiate future agreements to use facilities and/or services. They also provide that the cities and the borough will not allow their property to be used to conduct similar competitive games during the week that the Arctic Winter Games are scheduled to occur, which is March 5 - 11, 2006. This is based upon a requirement in the agreement entered between the Kenai Peninsula Borough and the Arctic Winter Games International Committee. Use of the Arctic Winter Games logo is also restricted to uses authorized by the international committee.

The assistance and cooperation from these cities continues to be an essential part of successfully staging the games. Assembly approval of this resolution is respectfully requested.
