Subject: Resolution 2004-077 Classifying Borough land located in

North Kenai, Sterling, Kalifornsky Beach, Ridgeway, Clam Gulch, Anchor Point, Fritz Creek, Diamond Ridge, Seward, and Gray Cliff areas

Pursuant to KPB Code of Ordinances, Chapter 17.10.080, classification provides direction on how the Borough should manage its land. Borough land classified appropriately for disposal is deposited into the Land Bank and may be then offered for sale at a later date. If this resolution is adopted, the listed parcels will be recommended for a sealed bid sale.

Pursuant to KPB Chapter 17.10.080, public notice was published and notification was sent by regular mail to all owners and/or leaseholders of record within a one-half mile radius of the parcels proposed for classification. Notice was also sent to all KPB agencies. The notice consists of a cover letter, map, and list of land classification definitions.

The Planning Commission held a public hearing on July 19, 2004 and recommended adoption of the subject resolution by unanimous consent with the following two recommended amendments.

1) Recommend changing the classification of Parcel 172-360-01 to agricultural rather than rural. This amendment was included in the main motion and passed unanimously.

2) Recommend the two parcels in Seward with parcel numbers to be assigned (that are proposed to be classified "commercial,") be designated "preservation" in accordance with the Seward/Bear Creek Flood Service Area recommendations. This amendment passed by a 6-5 vote.
