SUBJECT: Resolution 2004-043 approving an intergovernmental cooperative agreement

1. As written, Resolution 2004-43 only authorizes the mayor to execute the cooperative fire protection agreement on behalf of the various fire service areas in the borough. However, the office of emergency management is often called on by the Division of Forestry to cooperate with it in the event of a wildland fire. The Office of Emergency Management could provide the command vehicle on a temporary basis and does provide personnel for incident management purposes. The administration respectfully requests that the assembly amend Resolution 2004-043 to authorize the mayor to execute the cooperative agreement on behalf of the borough as well as the listed service areas. The amendment would read as follows:

This agreement is dated the _____ day of _____________, 2004, and is between the Kenai Peninsula Borough, on behalf of itself and Anchor Point Fire and Emergency Service Area, Bear Creek Fire Service Area, Central Emergency Service Area, Kachemak Emergency Service Area, Lowell Point Emergency Service Area, and Nikiski Fire Service Area, ("Cooperators") with an address of 144 N. Binkley St., Soldotna, Alaska 99669, and the State of Alaska, Department of Natural Resources, Division of Forestry ("State"), Kenai/Kodiak Area with an address of 42499 Sterling Highway, Soldotna, Alaska, 99669.

2. Please fill in the blank in the last Whereas clause as follows:

Central Emergency Service Area: at its March meeting recommended supporting a resolution approving the intergovernmental cooperative agreement.

Nikiski Fire Service Area: at its March meeting recommended adopting the cooperative fire protection agreement and the annual operating plan format.

Bear Creek Fire Service Area: at its March meeting recommended adoption of the intergovernmental cooperative agreement.

Anchor Point Fire and Emergency Medical Service Area: at its March meeting the board recommended the resolution.

Lowell Point Emergency Service Area: at its April meeting, the board recommended adoption of the resolution.

Kachemak Emergency Service Area: by consensus the board approved the prepared draft with provision made for payment for vehicle use after 2 hours.
