SUBJECT: Resolution 2004-030: A Resolution Authorizing the Rejection of Certain Municipal Entitlement Selections within ADL 201302 near Hope, Alaska

The Kenai Peninsula Borough ("KPB") selected lands near Hope in 1979. Since that time, certain portions of the selection have been severely altered. Title to the land has been clouded, trespass has occurred, and the property has been contaminated.

The administration believes that this selected land is not in conveyable form, and that the public interest would be best served if KPB remained out of the chain of title, and therefore recommends that the assembly authorize the administration to relinquish the affected selection or otherwise reject title to the affected lands.

The KPB Planning Commission will consider this resolution at its regularly scheduled meeting of March 8, 2004, and the action taken will be reported to the assembly.
