SUBJECT: Resolution 2004-018, authorizing the mayor to enter into an agreement with the Anchor Point Volunteer Fire Department and Rescue, Inc.

This resolution authorizes the mayor to sign the accompanying agreement for the provision of fire and emergency medical rescue services in the Anchor Point Fire & Emergency Medical service area. To date, there is no formal agreement between the borough and the volunteers who provide services. The agreement states that the volunteer fire department will provide all firefighting, fire prevention, emergency medical services, training, and equipment and facilities maintenance services for the service area. In exchange, the service area will provide appropriate equipment and facilities to be used in providing firefighting services. Additionally, the borough will provide workers' compensation insurance, liability insurance and public officials liability insurance for claims arising in connection with the firefighting and emergency medical services provided by the nonprofit corporation. It places financial controls upon the expenditure of funds by requiring that the service area board approve all expenditures in excess of $200 before the obligation is incurred, except that in an emergency the service area board chair may approve such an expenditure. Under this agreement no compensation is paid to any member of the service area board or the fire department for services provided except for standard volunteer stipends and services rendered through mutual aid or cooperative agreements as approved by the service area board. Assembly approval of this agreement is respectfully requested.
