Subject: Awarding contracts for the work of art project at the Tustumena Elementary
Addition.
Ordinance 94-09 for design, construction and equipping of the Tustumena Elementary
Addition was enacted by the assembly in April 1994. At the time of the enactment, it was
the School District's and the Borough's understanding that this project was not subject to
the 1% for Art in Public Places statute requirements, AS 35.27.010-030. During the close
out of the project, notification was received from the State of Alaska that this project
was subject to this requirement.
Alaska Statute 35.27.010-030 requires that at least one percent of the construction costs
of a building or facility approved for construction by the legislature will be reserved
for art. The Tustumena Elementary Addition was 70% funded by the State of Alaska, DOE
project # 09-94. This joint funding requires that the Borough comply with the 1% for Art
in Public Places requirement. The work of art requirement on this project is at least
$36,826.
An art selection committee was formed with representatives of the art world, the community
of Kasilof, the site council, the school and the school district staff. The committee
prepared a proposal request that was sent throughout the state. Based upon responses that
were received, the committee selected two artists; Mr. Tom Stewart of Talkeetna and Mr.
Michael Anderson of Cordova to prepare works of art for the Tustumena Elementary Addition.
There are funds currently set aside to pay for the art projects in account
401.71130.MO994.49999. The art selection committee is asking the assembly to approve the
awarding of contracts to Mr. Tom Stewart in the amount of $18,260 and to Mr. Michael
Anderson in the amount of $18,566, for art projects for the Tustumena Elementary Addition.
