ORDINANCE 2004-19-48

AN ORDINANCE ACCEPTING AND APPROPRIATING A DIRECT LUMP SUM PAYMENT OF $2,071,000 FROM THE U.S. FOREST SERVICE TO IMPLEMENT FOR AREAS AFFECTED BY THE SPRUCE BARK BEETLE ACTION PLAN

WHEREAS, more than 1,500,000 acres within the Kenai Peninsula Borough have been infested with spruce bark beetles during the recent spruce bark beetle outbreak; and

WHEREAS, the Kenai Peninsula Borough established the Spruce Bark Beetle Mitigation Program in 1999 to implement and administer an action plan for managing the spruce bark beetle outbreak in Alaska; and

WHEREAS, the United States Congress and the Alaska congressional delegation are very concerned about the continued potential for fire hazards caused by the spruce bark beetle outbreak; and

WHEREAS, a congressional appropriation of $2,071,000 has been made available in the form of a direct lump sum payment to the Kenai Peninsula Borough for mitigation activities; and

WHEREAS, the Spruce Bark Beetle Mitigation Program is currently implementing and administering an action plan for mitigation activities that was approved by the Kenai Peninsula Borough Assembly through KPB Ordinance 2000-19-19;

NOW, THEREFORE BE IT ORDAINED BY THE ASSEMBLY OF THE KENAI PENINSULA BOROUGH:

SECTION 1. That the mayor is authorized to accept the direct lump sum payment in the amount of $2,071,000 from the U.S. Forest Service to address the spruce bark beetle outbreak.

SECTION 2. That the Phase IV Program Outline attached to this ordinance is approved and shall guide the administration's expenditure of the funds.

SECTION 3. That these direct lump sum funds are appropriated to Account No. 262.21320.05BTL.49999 to continue mitigation activities approved by KPB Ordinance 2000-19-19.

SECTION 4. That the mayor is authorized to execute all documents deemed necessary to complete this project in accordance with this ordinance.

SECTION 5. That due to the length and nature of this project, the appropriations established through this ordinance shall not lapse at the end of any particular fiscal year.

SECTION 6. That this ordinance takes effect immediately upon enactment.
