RE: Ordinance 2004-28 Approving Grande View Heights One Local Option Zoning District as Single Family Residential (R-1), and Amending KPB Chapter 21.46.040

The Planning Department received a petition from Salamatof Native Association, Inc. (SNA) on July 13, 2004 requesting the formation of a Single Family Residential (R-1) Local Option Zoning District (LOZ). SNA is in the process of subdividing property in the Sterling area. The proposed LOZ would include all lots in the proposed Grande View Heights Phase 1 Subdivision, of which SNA is currently the sole property owner. Because the property is under single ownership, LOZ Area and Petition Requirements (KPB 21.44.040) are not required.

The accompanying map shows the vicinity of the proposed R-1 LOZ district, and the accompanying plat depicts the lots to be included in the LOZ boundary. Pursuant to KPB 21.08, property owners may petition the assembly for greater restriction on land use than otherwise provided in Title 21 of the KPB Code. Furthermore, the proposed LOZ is consistent with Goal 5.4 of the KPB Comprehensive Plan, which is to maintain the freedom of property owners in rural areas of the borough to make decisions and control use of their private land.

On August 23, 2004, the KPB Planning Commission will hold a public hearing and make a recommendation regarding the formation of the R-1 district. That recommendation will be reported to the Assembly.
