SUBJECT: Ordinance 2003-33 authorizing the sale of 41 parcels of borough land by outcry public auction

KPB 17.10.070(A) directs that two land sales be conducted each year. One sale is the tax foreclosure outcry auction. The other sale is a competitive market value sale. The subject ordinance recommends 41 parcels for sale by outcry public auction. Land Management staff reviewed the land bank inventory and recommended the 41 parcels based on size, price, location, soil conditions and access. Maps showing the location of each parcel are attached.

The outcry public auction will be held in the Assembly Chambers of the Borough Administration building on October 4, 2003. A shortened hearing is requested for this ordinance to allow for the October 4, 2003 auction date. October 4, 2003 is selected as the earliest date the auction can be held and still meet advertising requirements to avoid snowy road conditions that could prevent bidders from attending the auction.

Brochures will be available on September 1, 2003 and the newspaper advertisement will begin September 3, 2003 to meet the advertising requirements of KPB 17.10.110. The brochures will delineate the parcels and explain the outcry public auction process and procedures. All parcels will have the front property corners marked and sale signs posted except those parcels located in the Gray Cliff and Moose Point Subdivision.

Parcels that do not sell at the outcry public auction will be added to the on-going over-the-counter land sale authorized by Ordinance 2001-31, Section 5.
