SUBJECT: ORDINANCE 2003-09 AN ORDINANCE AUTHORIZING THE LEASE OF 54 ACRES LOCATED WITHIN THE BUFFER PROPERTY OF THE CENTRAL PENINSULA LANDFILL TO KENAI PENINSULA ARCHERS AT LESS THAN MARKET VALUE

The Kenai Peninsula Archers (KPA) operated an archery club on landfill buffer property for ten years as authorized by ordinance 92-33. The lease area was approximately 68 acres. That lease expired on November 30, 2002. Renewal of that lease is not possible because a portion of the lease area is now designated by the Solid Waste Department as Central Peninsula Landfill area and is needed for expansion.

The 54 acres the KPA is now proposing to lease is all within the landfill buffer. 4.7 acres of the proposed area was also included in the former lease area. The remaining 49.3 acres are adjacent, and are comprised of Borough lands not previously leased by the KPA. The proposed lease area is not part of the planned landfill expansion area.

The KPA provides an authorized location for archery related activities and the new lease area is suited for those activities. The KPA supports a continuous educational program through its involvement in Alaska Hunter Education and the International Bowhunter Education Programs.

The KPA continues to provide the same services that supported a less than market value lease under ordinance 92-33 and the activities conducted by the KPA have proven compatible with the purposes of the landfill buffer property. KPA activities on this parcel are currently being conducted under a Kenai Peninsula Borough Land Use Permit.
