SUBJECT: Ordinance 2002-27 Negotiated Sale at Other Than Market Value of Lot 16, Block 7, Irons Subdivision, of Block 7 and Lot 8 of Block 9, According to Plat No. 72-5, Kenai Recording District to Marie L. Parker; Assessor Parcel No. 057-370-16-5

The Kenai Peninsula Borough (KPB) has foreclosed on subject Lot 16 for delinquent real property taxes. Ordinance 99-32 retained Lot 16 for a public purpose because it is less than 40,000 square feet. However, Lot 16 is used in conjunction with the contiguous Lot 17 to provide the site for a large house owned by Marie L. Parker. Part of the house, driveway, well and other improvements are located on Lot 16. Please reference the attached site map.

The public purpose of retaining a non-conforming lot is exceeded by the public purpose of creating a lot conforming to subdivision regulations. It is also not feasible for the KPB to continue managing Lot 16 as it is actively used to support the house.

Marie Parker, the previous owner, has signed an application for the negotiated sale of Lot 16 in which she agrees to pay all delinquent taxes, interest and costs associated with Lot 16. As of June 27, 2002 the total delinquent taxes, interest and costs on this parcel are $8,639.92. The assessed value of the parcel is $13,300. The application also states that Ms. Parker will pay the cost of having Lots 16 and 17 platted into one lot that will conform to subdivision regulations. Ms. Parker currently resides in Las Vegas, Nevada. Ms. Parker has given her son Ken Hansen a power of attorney to resolve this issue.
