KENAI PENINSULA BOROUGH

ORDINANCE 2002-10

AN ORDINANCE AMENDING THE BOROUGH CODE TO REVISE ASSEMBLY DISTRICT BOUNDARIES

WHEREAS, in Resolution 2001-040, the assembly declared itself malapportioned and in Ordinance 2001-25 submitted two assembly apportionment plans to the voters; and

WHEREAS, in the October 2, 2001 election, the Kenai Peninsula Borough voters approved an apportionment plan with nine single-member assembly districts with each assembly member elected from one district; and

WHEREAS, in Ordinance 2001-39, the assembly provided for the assembly composition and form of representation that received the most votes as required by AS 29.20.070(d); and

WHEREAS, the assembly must by ordinance adopt the legal descriptions for final assembly districts which comply with equal representation requirements of the United States Constitution; and

WHEREAS, a committee consisting of three assembly members and the borough clerk has recommended assembly district boundaries which comply with federal law and are substantially similar to the tentative maps provided to the voters for the October 2001 election and which also follow, to the extent feasible, the state precinct lines in order to help ensure simplicity and accuracy of the ballot process in future elections; and

WHEREAS, because Seldovia has more in common economically and culturally with the Diamond Ridge area than it does with the City of Homer, the Seldovia area shall be included with the Diamond Ridge district; and

WHEREAS, as the annexation of a portion of the City of Homer has been approved, the Homer/Kachemak district shall be expanded to include the newly annexed area, thereby keeping the entire city within one district and providing for a commensurate reduction of the district extending along East End Road; and

WHEREAS, the eastern boundary of the Soldotna district is revised to follow the new state precinct line, the southern boundary is revised to include that portion of Funny River Road bounded on the east and west by Soldotna City Limits, and the western boundary is revised to compensate for the additional population gained with the previous two additions; and

WHEREAS, in order to offset the adjustment to the Soldotna district, both the Sterling and the Kenai South districts are revised; and

WHEREAS, a revision to the Seward district's western boundary has no effect on the population of the district because the affected area lies completely within an unpopulated area of the borough; and

WHEREAS, the changes to the southern boundary of Assembly District 3 (Nikiski) increases the district's population by approximately five percent and, therefore, does not sufficiently change the voter population to require truncation of the incumbent's term of office; and

WHEREAS, the assembly finds that the above-described adjustments are made for the purpose of including populations with similar economic, cultural, and social interests and/or to retain consistency with political boundaries;

NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KENAI PENINSULA BOROUGH:
