Mr. Moss called the meeting to order at 11:05 AM


Mr. Moss opened the public comment period. Several members of the public offered the following concerns and recommendations regarding Ordinance 2001-47:

Buzz Kyllonen, PO Box 49, Anchor Point, Road Service Area Board Member, indicated the problem lay with the original 595 miles of road way accepted into the road service area in 1985. He also stated that to date, only 35 miles of new roads had been accepted into the road service area since 1985. He reviewed the ordinance by paragraph offering suggested amendments and pointing out his perceived problems with the ordinance. His suggested amendments are attached. He also suggested including a plat note that states, "ROADS ARE NOT MAINTAINED BY THE BOROUGH", if that is the case.

Lee Wiley, stated some permits have been issued for roads not built to borough road standards. He felt that if the ordinance passed as written it would stop development in the borough.

Cliff Baker, Integrity Surveys, 605 Swires Drive, Kenai, stated that he is in favor of the ordinance in concept; however, as written, it does not address the problems that exist with the roads already in the road service area.

Milli Martin, KPB Assembly Member, indicated the purpose of the ordinance was to ensure that new roads are built to borough standards prior to being accepted into the service area.

Jerry Anderson, PO Box 378, Homer, indicated the ordinance is a solution in search of a problem. He did not agree with the concept of forcing one standard on all developers. He indicated the only problem he perceived was that perception did not match expectations. He felt the problem could be solved through full disclosure on a plat map of whether the road would be maintained by the borough or not. He recommended the following:

Paul Simonds, PO Box 39526, Ninilchik; Mr Simonds suggested the section line easement requirement be deleted from Section 1.

Roger Imhoff, PO Box 2588, Homer, stated responsible developers were already building good roads. He indicated there was a need to allow for less expensive development to take place to provide property for those who cannot afford higher end properties. He felt the borough had an obligation to make it less restrictive for developers to build quality roads. He indicated the available gravel in the Homer and Anchor Point area was substandard.

Tom Hall, Real Estate Agent, Homer, indicated the real estate market was efficient at providing what the public wanted. He indicated it was unfair to require developers to build roads that would benefit adjoining property owners with out requiring those property owners to share in the cost. If the ordinance passed, he would like to see some of the cost of building the road passed on to the adjacent property owners. He did not approve of the exemptions for smaller size lots. He suggested developers and the borough could sign an agreement stating that lots could not be sold prior to roads being constructed.

Dick Troeger, PO Box 4526, Soldotna, Planning Commission Member, stated he is not in favor of the ordinance. He specifically did not approve of the prohibition of exceptions in Section 2. F. He felt there should be an escape clause in all ordinances dealing with property rights.

Tom Clark, Anchor Point, stated that the ordinance, as written, would constrict growth.
