SUBJECT: Ordinance authorizing a negotiated lease to AT&T Wireless Services for a communication tower site on the north side of Skyview High School.

McCaw Communications of Anchorage, Inc., an Alaska Corporation, dba AT&T Wireless Services, has submitted an application for the negotiated lease of a 0.13 acre parcel located within the SE�SE�, Section 1, T4N, R11W, S.M., Kenai Recording District, Third Judicial District, State of Alaska for construction of a communication tower. AT&T Wireless Services requests that the lease agreement include the following terms:

An initial annual rental rate of $6,000 that will increase 3 percent each year for the term of the lease.

Initial lease term of five years, with the option to renew the lease for five additional five-year terms.

24-hour access for maintenance and emergency purposes.

AT&T Wireless Services originally submitted an application to lease a site on Kenai Peninsula Borough (KPB) land encumbered by the lease with the Tsalteshi Trail Association (TTA). The KPB, Soldotna City Council, AT&T Wireless Services, and neighborhood residents held a work session at the City of Soldotna on February 14, 2001, to discuss alternative sites. At the work session AT&T Wireless Services agreed to work with the KPB and neighborhood residents to locate an alternative site. The above-described site is the agreed-upon alternative.
