ORDINANCE 2001-10

AN ORDINANCE AUTHORIZING A LONG-TERM LAND USE PERMIT WITH THE BOYS AND GIRLS CLUB AND HEAD START PROGRAM IN SELDOVIA

WHEREAS, the Boys and Girls Club and Head Start program provide vital family support services in the community of Seldovia; and

WHEREAS, the Boys and Girls Club and Head Start programs provide services compatible with education functions; and

WHEREAS, the Boys and Girls Club in Seldovia operates out of the ball closet in the Seldovia school gymnasium; and

WHEREAS, the Seldovia Head Start program's current facility is being demolished this summer, and space is needed by the beginning of the 2001-02 school year; and

WHEREAS, the Boys and Girls Club has an opportunity to receive grant funding to construct a building; and

WHEREAS, the KPB school board voted on February 19, 2001, to make land available for a portable building for the Boys and Girls Club and Head Start program adjacent to the Seldovia Susan B. English School building; and

WHEREAS, the City of Seldovia is contributing a Community Development Block Grant to the Seldovia Community Center project which would house the Boys and Girls Club and Head Start program that must be expended by September 30, 2001; and

WHEREAS, a lease would require subdivision of the school land, and the school district intends to keep the land for long-range educational purposes; and

WHEREAS, a permit to place a portable building on the land would not require subdivision of the land; and

WHEREAS, Title 17 of the borough code only provides for a short term land use permit; and

WHEREAS, a permit arrangement is appropriate because it creates no interest or title in the real property underlying the portable building

NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KENAI PENINSULA BOROUGH:

SECTION 1. Notwithstanding KPB 17.10.180, the assembly authorizes the administration to issue a long-term permit for a period of ten years to the Boys and Girls Club and Head Start program in a form substantially similar to that attached.

SECTION 2. The permit shall be for the purposes of placing a portable building for use by the Boys and Girls Club, Head Start program, and other community activities at the Susan B. English School site in Seldovia legally described as follows:

Tract 3B, Fleming Giles Estates No. 2, Seldovia Recording District, Third Judicial District, State of Alaska

SECTION 3. This ordinance takes effect immediately upon enactment
