SUBJECT: Proposed Amendments to Ordinance 99-71 Substitute

                    South Peninsula Recreation Service Area

Upon further consideration, following are a couple of proposed amendments to Ordinance 99-71 Substitute. These would amend the legal description of the service area to exclude the Anchor Point area, and reduce the number of directors back from seven to five, with three from outside the Homer city limits and two from within. Attached is a map depicting the proposed modified area. Section 2 of the ordinance is also amended to provide for staggered terms for five directors rather than seven. The changes from the substitute language are shown in bold.

Amend the 7th "Whereas" as follows:

WHEREAS, the most recent population figures available for the proposed area show that approximately [58] 49% of the service area population resides outside of the cities of Homer and Kachemak City, [38] 46% resides inside the City of Homer, and [4]5% resides inside of Kachemak City; and

Amend Section 1 as follows:

16.74.010. Established--Boundaries.

There is established pursuant to AS 29.35.450 a service area within the borough designated the "Kenai Peninsula Borough South Peninsula Recreation Service Area" including that portion of the borough inside and outside the city limits of Homer described as follows:

[T4S, R10W, R11W, R12W, R13W, R14W, R15W, T5S, R15W, R14W, R13W, R12W, R11W, T6S, R 15W, R14W, R13W, R12W,] T5S, R11W, R12W, and T6S, R12W, R13W, R14W, R15W, Seward Meridian, Alaska, and all land within the corporate boundaries of the city of Homer.

16.75.020. Board--Established--Nomination and election of members.

There is established a board of directors for the Kenai Peninsula Borough South Peninsula Recreation Service Area composed of [seven] five members who shall be residents of the service area and elected by the qualified voters of the service area as provided in KPB 4.20.020 and KPB 16.04.065. There shall be [four] three members elected from the area of the service area residing outside of the city limits of Homer (Seats A, B, and C[, and D]), and [three] two members elected from within the city limits of Homer (Seats E[,] and F[, and G]).

Amend Section 2 as follows:

SECTION 2. That the service area board shall be elected at the election establishing the service area. Notwithstanding the provisions of KPB 16.74.050, board seats to be elected at the ______________, 2000, special election shall be staggered as follows: Seats A and [E] D for one year; seats B[, C, and F] and E for two years; and seat[s D and G] C for three years.
