Subject: Ordinance 99-54: An Ordinance Establishing the North Fork One Zoning District

Chapter 21.08 of the Kenai Peninsula Borough Code provides for property owners to petition the Assembly for a greater land use restriction on their property. In April 1999, the Planning Department received a petition and draft ordinance to establish the North Fork One Zoning District.

Fourteen (14) contiguous property owners residing in the vicinity of North Fork Road, Spruceridge Loop and Anchor Point Avenue initiated the petition. If enacted by the Assembly the area would be zoned residential. As drafted, any structure or use, which existed prior to the adoption of the zoning district, would be allowed to continue; however, its use could not be expanded. Home occupations would be permitted within the district after a public hearing and obtaining a permit from the Planning Commission.

A substantial portion of the proposed ordinance defines many of the uses contained in the document.

A copy of the proposed ordinance, zoning map and memorandum are being provided to the affected property owners within the proposed district so they may testify at the September 7, 1999 Borough Assembly meeting.
