| ORDINANCE 93-33 |
AN ORDINANCE AMENDING CODE PROVISION
REGARDING LIMITING TERMS OF OFFICE FOR THE ASSEMBLY, MAYOR,
AND SCHOOL BOARD TO TWO CONSECUTIVE TERMS
WHEREAS, the voters at the
October 1992, borough election favored term limitations for
elected municipal officials; and
WHEREAS, under Title 29 of the
Alaska Statutes, an ordinance containing term limitations must be
submitted to the voters before it becomes effective;
NOW, THEREFORE, BE IT ORDAINED BY THE
ASSEMBLY OF THE KENAI PENINSULA BOROUGH:
SECTION 1.That KPB Ordinance
92-55 is repealed.
SECTION 2. That KPB 22.30.030
is amended by adding a new subsection C to read:
C. No person who has completed two consecutive
full terms on the assembly may serve another term or portion of a
term until a period of 180 days has passed since the end of that
person's second consecutive full term of office. A full term of
office means the regular term of office for assembly member, and
does not include portions of a term served by appointment or
election to the remainder of an unexpired term vacated by another
person. This limitation shall only apply to full terms of
incumbent assembly members commencing with or after the October
1993 Regular Municipal Election.
SECTION 3.That KPB 2.04.010 is
amended to read as follows:
2.04.010. Term of Office--Limitation of terms.
The term of office of the borough mayor is 3
years. No person who has completed two consecutive full terms
as mayor may serve another term or portion of a term until a
period of 180 days has passed since the end of their second
consecutive full term of office. A full term of office means the
regular term of office for mayor and does not include portions of
a term served by appointment or election to the remainder of an
unexpired term vacated by another person.
SECTION 4.That KPB 1.20.100 is
amended by adding a new subsection C, to read as follows:
C. Limitation of term of office. No
person who has completed two consecutive full terms as a member
of the school board may serve another term or portion of a term
until a period of 180 days has passed since the end of their
second consecutive full term of office. A full term of office
means the regular term of office for the school board and does
not include portions of a term served by appointment or election
to the remainder of an unexpired term vacated by another person.
This limitation shall only apply to full terms of incumbent
school board members commencing with or after the October 1993
Regular Municipal Election.
SECTION 5.That ratification of
each of the term limitations adopted by this ordinance shall be
placed before the voters as separate propositions at the next
regular municipal election to be held in October 1993.
SECTION 6.That no provision of
this ordinance shall cause a person serving a term in excess of
the limits imposed to vacate that office or cut short the term
for which he or she was elected or appointed. Such individual
shall be entitled to the remaining portion of their elected or
appointed term.
SECTION 7.That if ratified by
the voters at the next regular municipal election, Sections 1, 2,
and 3 of this ordinance shall take effect on January 1, 1994.
