NOTICE IS HEREBY GIVEN that the Regular Election will be held in the Kenai Peninsula Borough on Tuesday, October 5, 2004, for the purpose of
1. Electing the following officials:
A. Borough Assembly Members: To be elected from the designated districts by the qualified voters of that district.
1. Seat 3 (Nikiski - 2-year term) - Voters residing in Nikiski, Salamatof and Tyonek Precincts and a portion of the Kachemak Bay Precinct located on the west side of Cook Inlet.
2. Seat 4 (Soldotna - 2-year term) - Voters residing in Soldotna, Mackey Lake and a portion of Central Precinct.
3. Seat 7 (Central - 2-year term) - Voters residing in Kasilof, Ninilchik and portions of Central and K-Beach Precincts.
B. Board of Education Members: To be elected from the designated districts by the qualified voters of that district.
1. Seat 1 (Kalifornsky- 3-year term) - Voters residing in Kenai 3 and a portion of the Central and K-Beach Precincts.
2. Seat 6 (East Peninsula - 3-year term) - Voters residing in Seward, Bear Creek, Moose Pass, Hope and Cooper Landing Precincts.
3. Seat 9 (South Peninsula - 3-year term) - Voters residing in the Kachemak Bay Precinct (which includes Nanwalek and Port Graham but excludes that portion of the precinct on the west side of Cook Inlet), Seldovia, Diamond Ridge, Anchor Point, and that portion of the Kachemak City-Fritz Creek Precinct outside the city limits of Kachemak City.
C. Service Area Board Members: To be elected by the qualified voters of each service area as follows:
1. Anchor Point Fire and Emergency Medical Service Area Board - Seat B for a 3-year term and Seat C for a 2-year term.
2. Central Peninsula Hospital Service Area Board - Seat A and B for 21year terms, Seat E for a 2-year term and Seats F and G for 3-year terms.
3. Joint Operations Board for the Central Peninsula Emergency Medical Service Area and the Central Emergency Service Area Board - Seat B for a 3-year term.
4. Kachemak Emergency Service Area Board - Seat E for a 3-year
5. Nikiski Fire Service Area Board - Seats A, B and C for 3-year terms.
6. Nikiski Law Enforcement Service Area - Seat A for a 1-year term, Seats B and C for 2-year terms and Seats D and E for 3-year terms.
2. Submitting the following propositions to the qualified voters of the Borough:
Ordinance 2004-23, Section 1, would increase the allowable residential property tax exemption for qualifying taxpayers from $10,000 to $20,000. Shall Kenai Peninsula Borough Ordinance 2004-23, Section 1, be ratified?
PROPOSITION NO. 2 - Proposed Nikiski Law Enforcement Service Area
(To be voted on by voters residing in the proposed new service area)
Shall the Kenai Peninsula Borough be authorized to exercise law enforcement powers to provide law enforcement services in the Kenai Peninsula Borough Nikiski Law Enforcement Service Area within the service area boundaries defined by Ordinance 2004-10?
Shall Initiative Ordinance 2004-01, clarifying the powers exercised by the North Peninsula Recreation Service Area, be adopted? This ordinance seeks to prohibit the service area from providing services that do not directly support the primary service area function of providing recreation and specifically prohibits the service area from using or committing taxpayer funds to provide for a community meeting hall, prepared food facilities, or the conversion of municipal buildings hat would sublet to nonprofit organizations, police or other organizations in order to support any larger project underwritten by the taxpayers of the service area.
Shall Initiative Ordinance 2004-03, reducing the cost of capital improvement projects funded by the North Peninsula Recreation Service Area requiring voter approval from $1,500,000 to $500,000 (including projects funded by federal or state grants), be adopted?
Shall the Kenai Peninsula Borough be authorized to exercise powers to provide fire protection and emergency medical services through the expansion of the Kenai Peninsula Borough Central Emergency Service Area into the Funny River area as defined by Section 1 of Ordinance 2004-22?
Shall the Kenai Peninsula Borough be authorized to exercise powers to provide fire protection and emergency medical services through the expansion of the Kenai Peninsula Borough Central Emergency Service Area into the Kasilof / Cohoe / Clam Gulch area as defined by Section 2 of Ordinance 2004-22?
VOTER QUALIFICATIONS: A qualified voter is a person who is a citizen of the United States, at least 18 years of age, who has been a resident of the State of Alaska and the Kenai Peninsula Borough for at least 30 days immediately preceding the election and who has registered as an Alaska voter at least 30 days preceding the election.

*NOTE: These precincts will not have a polling place open on election day. Every registered voter residing within these precincts will be mailed a ballot prior to the election.
POLLING HOURS: The polls will be open from 7:00 a.m. to 8:00 p.m. on election day.
ABSENTEE VOTING: Any qualified voter who expects to be absent from his/her election precinct or who will be unable to go to the polling place of that precinct for reasons of physical disability may cast an absentee ballot. A qualified voter may apply for an absentee ballot by mail or by electronic transmission (FAX). A voter may apply for an absentee ballot in person on any day beginning September 20, up to and including election day. A voter who is unable to go to the polls because of physical disability may apply through a personal representative on the day of or before the date of the election.
